STEMZ Project Terms & Conditions

 

By registering for and/or participating in any Zionsville RISE Foundation, Inc. (“RISE”) STEM education lab, workshop, class, course, or competition (hereinafter “STEMz Project Program”), I acknowledge that I have read all the Terms and Conditions below and agree to be bound by them on behalf of myself and my child(ren) (hereinafter “student(s)”).

 

1. Code of Conduct

I agree that I have read through, understand, and agree that I and my student will be held to the Code of Conduct set forth below. I also agree that I have reviewed the Code of Conduct with my student. I understand that I and my student must act in a way that is in keeping with the Code of Conduct and that my student can be dismissed from a STEMz Project Program if either of our actions or attitudes seem to be disruptive or harmful to the atmosphere, participants, or staff. I understand that RISE reserves the right to dismiss anyone from a STEMz Project Program without prior warning for violating the terms of this Code of Conduct. I also acknowledge that upon staff observation of my student at the STEMz Project Program, RISE may determine that the STEMz Project Program is not a suitable and/or productive environment for my student. In this case, RISE may dismiss the student. RISE strives to maintain excellent relationships with students. However, in some rare cases, RISE may not be a compatible environment for every student.

During the STEMz Project Program:

    1. Students and Parents/Guardians May NEVER:
      1. engage in or threaten violence;
      2. bully, criticize, intimidate, or harass others;
      3. damage facilities or equipment;
      4. smoke, use tobacco, or vape products; or
      5. use, possess or be under the influence of alcohol, marijuana, or any illegal or un-prescribed legal drug (If a student is caught using, possessing or being under the influence of illegal or un-prescribed substances, he/she may be permanently banned from the STEMz Project and/or future RISE activities.
    2. Students Also May NEVER:
      1. view inappropriate material (including sexual content, inappropriate violence, racism, bullying, etc.) on the internet;
      2. steal or use without permission the property of others;
      3. inappropriately use program, equipment, tools, or materials;
      4. engage in internet hacking;
      5. use or possess weapons (If possession of weapons is suspected, student will be subject to search and seizure. If a student is found in possession of a weapon, he/she will be immediately dismissed and permanently banned from the STEMz Project and/or future RISE activities);
      6. bring pets or animals to RISE (unless a service animal) without permission of staff; or
      7. bring hoverboards or similar toys, roller blades or shoes with wheels.
    3. Students and Parents/Guardians MUST:
      1. abide by these rules and regulations; and
      2. respect facilities and property (parents are responsible for any intentional damage to facilities or property by a student).
    4. Students Also MUST:
      1. not use personal electronic devices during instructional time – unless they are approved by the instructor (RISE does not facilitate internet access for any non-RISE devices.)

I understand that participation in the STEMz Project Program is free and registration is on a first-come first-serve basis. Once registration is full, I may place my student on the waitlist. The waitlist does not guarantee a spot in the STEMz Project Program and placement on the waitlist only applies for the current STEMz Project Program and does not carry over to any future programs.

 

2. Health and Safety

I understand that some activities at RISE contain inherent risks of potentially serious injury.

I certify that my student is in good health and able to participate in RISE activities, and that if for any reason my child should be restricted from participating in any activity, that I have provided RISE notification of such restrictions through the registration process associated with my student’s enrollment.

I authorize RISE staff to attend to any health issues or injuries my student may incur while participating in RISE activity. This includes providing basic first aid, administering authorized medications, and seeking emergency medical care for my student should they deem it necessary.

I agree to be financially responsible for any medical treatment needed during the duration of the STEMz Project Program. I understand that I am solely responsible for providing the insurance coverage for any medical treatment my student receives as a result of participating in RISE activities.

If my student needs to bring any medications to the program, I agree to bring all medications in original containers that identify (in English) the prescribing physician (if a prescribed medication), the name of the medication, the dosage, any side effects, and the frequency of administration. The information dosage and frequency of administration on the bottle must match the information provided on the registration forms. I agree that all medications, except inhalers and diabetic testing kits, will be given to and administered by RISE staff. If my student will be bringing an Epipen or similar, I will ensure that he/she brings at least one non-expired Epipens to each session of their STEMz Project Program to be kept in the possesssion of the student. My student will be required to self-administer all injectable medications under the observation of staff.

I understand that RISE staff cannot give my student over-the-counter medication without written permission.

I represent to RISE that my student is current on all vaccinations, excluding any COVID-19 vaccination status, according to the age-appropriate recommended immunization schedules published by the U.S. Centers for Disease Control and Prevention (CDC), and that my student poses no known risk to others while engaging in this activity. I further understand that if requested, I may be required to provide proof of vaccinations (not including for COVID-19) or other medical clearances necessary and appropriate for the activity and if I fail to do so, my student’s registration may be canceled without a refund.

I understand that the Emergency Contact I provide on the registration forms must be at least 18 years of age and must reside in the United States.

I UNDERSTAND THAT FOR MY STUDENT’S SAFETY, I MUST PROVIDE RISE WITH ACCURATE AND COMPLETE HEALTH, BEHAVIOR, AND DIETARY ISSUES/RESTRICTIONS.

COVID-19 Policy. I acknowledge the STEMz Project Program requires students to be on site. I understand RISE will follow the below precautions:

(a) The STEMz Project Program is limited to 20 students;
(b) Students and volunteers will follow social distancing during drop off and pick up;
(c) Symptom screening completed upon arrival at each session;
(d) Students will be assigned separate, dedicated workspace with any required technology and supplies;
(e) Each student will be provided with their own storage bin for curriculum-related supplies, items, etc.
(f) No parents or visitors will be permitted;
(g) Surfaces and equipment will be sanitized before and after each learning session;
(h) Students and guardians will be notified of any potential exposure to COVID-19; and
(i) Any student that displays symptoms of or tests positive for COVID-19 will stay home from any on-site session and RISE will aim to provide a make-up option for any missed sessions.
(j) Masks are not required during the program, but are recommended. They will be made available for any student who would like one.

 

3. Special Accommodations

If my student requires any special accommodations in order to participate in RISE activities, I will contact RISE no less than two weeks prior to my student’s first day. RISE will work with me to identify available reasonable accommodations.

If my student requires an aide at school then he/she will be accompanied by an aide at the STEMz Project Program, and that aide will be present for the duration of the session. The aide must be age 18 or older, may not be a family member, and must show a favorable result on a criminal background check and may be subject to fingerprinting. I acknowledge that I will be responsible for all direct costs, including background check processing fees and compensation, for the aide’s attendance.

 

4. Photo Release & Acknowledgement Regarding Other Activities

Photos: I authorize that photos, videos, images, audio, and testimonials may be taken of my student (if over the age of 5) and agree that said content may be used by RISE in promotional materials, marketing collateral, and online media. I understand that RISE , its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on right of privacy, defamation, and/or negligence. I agree that all images, testimonials, photos, video, and audio taken at or in connection with RISE are the sole and exclusive property of RISE. I agree to sign the Photo Release Form on behalf of my student, which is hereby incorporated by reference into this Agreement.

Projects/Take-homes: I understand that depending on the STEMz Project Program that my student takes, RISE may offer to send my student home with a working project, or post my student’s project to a project website, or send home a product or voucher for a product. I release RISE from any responsibility for failure to provide the project or product voucher, or a functioning/compatible/complete projects, product vouchers, or product. RISE staff will attempt to provide each participant with their completed project at the conclusion of the Program. I also agree that all projects and work created while at RISE may be used by RISE in promotional materials, online, and other print media. I agree that RISE , its owners, agents, partners, facility providers, and employees cannot be held liable for damages and injuries associated with said publishing, including any and all claims based on right of privacy, defamation, or negligence. I understand that if I have issues with a product voucher or product given as part of a STEMz Project Program, I must contact the manufacturer directly.

Software Accounts: I understand that some components of the STEMz Project Program may require creation or use of an online account during instructional time, or will require an online account to be created for access to program materials. I give consent for RISE to create account(s) as needed for my student to participate in STEMz Project Program activities.

 

5. Student Sign Out and Pick Up Policy

Pick-Up Policy: I agree to designate individuals on my student’s registration form who will be allowed to pick up my student from the STEMz Project Program. I acknowledge that only such designated individuals will be allowed to pick up my student from the STEMz Project Program. Should I need an unauthorized individual to pick up students from sessions, I will provide verbal consent via telephone to RISE.

Self-Sign-Out Policy: I agree that if my student is 14 or over and I have agreed to allow them to self-sign-out, he/she can sign himself/herself out. I further agree that when my student signs themselves out, they will no longer be in the care of RISE.

Sign-Out Policy for Others: I agree that if my student is 13 or under, he/she must be signed out of their STEMz Project Program only by an authorized pickup person. I understand and agree that only those named as authorized pick-up persons (and who show a valid picture ID, Driver License, or Passport) will be able to pick up my student.

Drop-Off/Pick-Up Times: I agree to drop my student off no earlier than 20 minutes prior to any session of the STEMz Project Program and to pick-up my student no later than 15 minutes after any session of the STEMz Project Program.

 

6. 18 and Over Policy

I understand that RISE offers teen-only STEMz Project Programs designed for students ages 11-18, and that students who are age 18 may interact with students throughout the duration of each STEMz Project Program session. I understand that by registering for a STEMz Project Program that accepts 18-year-old students, my student may interact with a student who is 18. I also agree that if I am 18 years old or more, that I agree, if requested, to successfully pass a criminal and sexual offender background check prior to being allowed to attend a STEMz Project Program (I agree to be responsible for all costs and fees associated with any background checks required for my student to attend.)

 

7. Course Cancellation by Rise

I agree that RISE has the right to cancel a course. If a course is cancelled, I understand that I may enroll my student in future STEMz Project programs. I understand that RISE may be forced to close or cancel a STEMz Project Program based on reasons beyond its control, such as in the case of a communicable disease outbreak or other acts of nature.

 

8. Customer Changes

I understand and agree that I am, without penalty, able to make changes to my student’s registration, so long as the changes are made more than seven days prior to the start date of the initial session of the STEMz Project Program.

 

9. Prizes

I understand that certain prizes will be offered by RISE on the final day of the STEMz Project Program. RISE will describe and explain the rules for winning a prize to the students. The approximate retail value (“ARV”) of the prizes will vary. All prize details will be determined by RISE in its discretion. Restrictions may apply. All expenses and costs associated with the acceptance or use of the prize that are not expressly specified in these Terms as being part of the prize are the responsibility of the winner. The prize may not be redeemed for cash. The right to receive the prize is not transferable. No substitution of the prize is permitted, except in the discretion of RISE, which reserves the right to substitute a prize of equal or greater value. All federal, state/provincial and local taxes on the prize value, if applicable, are the responsibility of the winner. An IRS form 1099 will be issued to the winner if required by law. 

 

10. Assumption of Risk & Release of Liability

I ACKNOWLEDGE THAT THERE IS AN INHERENT RISK OF INJURY IN PARTICIPATING IN STEMZ PROJECT PROGRAMS, PARTICULARLY IN A WORKSHOP/LABORATORY/MAKERSPACE ENVIRONMENT.  THEREFORE, I, FOR MYSELF AND ON BEHALF OF MY SON/DAUGHTER, IN EXCHANGE FOR THE RIGHT TO PARTICIPATE IN RISE’S ACTIVITIES AND STEMZ PROJECT PROGRAMS, FURTHER AGREE TO FULLY INDEMNIFY, RELEASE AND HOLD HARMLESS RISE AND ITS OWNERS, AGENTS, PARTNERS, AFFILIATES, SPONSORS, LOCATION AND FACILITY PROVIDERS, AND EMPLOYEES FROM LIABILITY (INCLUDING CLAIMS BASED UPON THEIR OWN NEGLIGENCE) FOR ANY AND ALL DAMAGES OR INJURIES TO MY SON/DAUGHTER OR DAMAGE TO ANY PERSONAL PROPERTY. TO THE EXTENT THAT THIS RELEASE CONFLICTS WITH ANY STATE LAW GOVERNING RELEASES, THIS RELEASE IS TO BE GIVEN THE FULLEST FORCE AND EFFECT PERMITTED UNDER STATE LAW. SHOULD ANY PART OF THIS CONTRACT BE FOUND INVALID OR NOT ENFORCEABLE BY A COURT OF LAW, THEN THE REMAINING PORTION SHALL CONTINUE TO BE VALID AND ENFORCEABLE.

 

11. Indemnity of RISE

I agree to defend, indemnify, and hold RISE, its affiliates, its sponsors, location and facility providers, officers, directors, agents, and employees, harmless from and against any claims, liabilities, damages, losses, and expenses (including, without limitation, attorneys’ fees and costs), which are proximately caused by my or my student’s participation in any STEMz Project Program.

 

12. Dispute Resolution Process, Choice of Law, Forum Selection

For any claim or dispute arising out of or relating to my or my student’s participation in any Program, whether on site or off site, I agree to temporarily forego any action in court and instead engage in two pre-lawsuit procedures prior to bringing any action in court, which are hereby specifically acknowledged as conditions precedent. Therefore, I agree to first deliver a demand in writing to RISE listing the factual basis(es) for the dispute and any request for remedy(ies) (monetary or equitable) sought. RISE will be provided thirty (30) days to respond to such demand before any further legal action is taken by me.  Thereafter, I agree to submit my dispute to non-binding mediation with an agreed-upon mediation service before filing any lawsuit in court.  In addition, I agree that any legal action shall only be brought in the Superior Court of Indiana, County of Marion and that the laws of the State of Indiana shall apply to all disputes hereunder. I hereby acknowledge that I understand the terms of this provision and agree to fully comply with each and every one of its terms.

 

13. Right to Modify Terms

RISE reserves the right to update or modify these Terms and Conditions at any time and that it is my responsibility to read these Terms and Conditions prior to participating in any Programs.

 

14. Trademark Notice

“STEM Education Works” is a registered trademark of STEM EDUCATION WORKS, LLC and RISE uses such trademark and other copyrightable materials with the permission of STEM EDUCATION WORKS, LLC. I agree to not do anything that infringes upon the trademark or other copyrightable materials by either company.  STEM EDUCATION WORKS, LLC has the right to seek immediate injunctive relief for any infringement on its trademark or copyrightable materials.
